Arizona Elder Fraud Losses Topped $343 Million in 2025, Advocates Say

PHOENIX - EntSun -- PHOENIX — Arizona seniors lost $343.98 million to fraud in 2025, an 80 percent increase from $191 million the year before, according to FBI Internet Crime Complaint Center data cited in the Arizona Attorney General's FY25 report. Arizona ranked fifth nationally for elder fraud losses by state, with 9,834 reported victims.

Part of the problem, elder law attorneys and senior advocates say, is a gap in how Arizona law defines who is protected. Arizona's "vulnerable adult" statute currently protects seniors only when a physical or mental impairment limits their ability to protect themselves, so a mentally sharp senior who is isolated and pressured into signing over a deed can fall outside it. Senate Bill 1512, which would have extended protection to seniors 65 and older facing isolation, sensory loss, or a recent spousal loss, did not pass; advocates are organizing to bring it back.

Lawmakers did pass a related law this year. Senate Bill 1479, effective September 2026, requires photo identification to record a deed in person and raises the penalty for recording a forged document to a Class 4 felony. It also requires county assessors to stand up a voluntary ownership-change notification system by January 1, 2027, in addition to the Arizona Department of Real Estate's own Early Real Estate Sales Alert program.

"A documented, fair-market process is one of the best protections a family has, because it creates the paper trail an elder law attorney needs if something looks wrong later," said Brad Kelley, broker and co-owner of National Network Realty.

Common warning signs include a caregiver who recently died or left, a senior isolated from family, a relative uninvolved in daily caregiving reappearing to push for deed changes, an unfamiliar new "helper," and pressure to sign documents quickly or in secret.
