~ Governor Gavin Newsom has signed a bipartisan measure that will give judges stronger tools to protect public safety and preserve access to mental health treatment. The bill, Assembly Bill 46, was introduced by Assemblymember Stephanie Nguyen and expands judicial discretion when determining whether diversion is appropriate for individuals with mental health issues.
The new law removes a narrow legal standard that previously restricted courts' ability to deny diversion and establishes broader judicial discretion based on public safety concerns. This means that judges will now have the ability to fully consider the implications of diversion requests while also ensuring access to treatment for those who are appropriate candidates.
In a statement, Governor Newsom emphasized the importance of balancing treatment and accountability in California's approach to mental health. He stated, "We are proud to preserve mental health diversion for people who can benefit from it while ensuring judges have the discretion they need to protect victims, safeguard communities, and make decisions based on the full picture before them."

Assemblymember Nguyen also expressed her gratitude for the passing of AB 46, which she says is the result of over three years of collaboration and hard work. She believes that this law strengthens public safety while still providing an important pathway to treatment through mental health diversion.
California's mental health diversion program was established with the goal of connecting eligible individuals with treatment and reducing recidivism. However, recent court decisions have limited how judges could evaluate public safety concerns in diversion cases. AB 46 clarifies the law and restores clarity to California's mental health diversion statute.
In other news, California continues to lead the nation in economic output according to new data showing a 4.2% increase in productivity by California workers in 2025. This marks the largest contribution of any state to national productivity growth.
Additionally, new findings across multiple reports highlight the success of California's Children and Youth Behavioral Health Initiative (CYBHI), which has made significant investments in youth behavioral health services across the state.
Finally, California leaders have responded to the U.S. Supreme Court's decision to uphold the current vote-by-mail process used by millions of Americans. This decision ensures that mail-in ballots will continue to be counted and people's voices will be heard in the democratic process.
