Noble World Foundation Calls on United Nations to End Religious Discrimination in Pakistan's Constitution

In a public appeal to the UN Human Rights Council, Noble World Foundation identifies religious identity laws as the legal root of terrorism and calls for their repeal.

CHICAGO - EntSun -- Noble World Foundation (NWF) has written an open letter to the United Nations Human Rights Council calling for the repeal of discriminatory provisions in Pakistan's Constitution that bar non-Muslims from holding the country's highest offices. These provisions, NWF argues, legally enshrine religious discrimination and contribute to a climate that fosters extremism and violence.

The open letter specifically challenges Articles 41(2) and 91(3) of Pakistan's Constitution, which explicitly restrict the offices of President and Prime Minister to Muslims:
  • Article 41(2): "A person shall not be qualified for election as President unless he is a Muslim…"
  • Article 91(3): "…proceed to elect without debate one of its Muslim members to be the Prime Minister."
"Islam began in 610 A.D.—there were no Muslims before the Prophet Muhammad (570–632 A.D.)," noted Shiv R. Jhawar, founder of Noble World Foundation. In his book Building a Noble World, he reflects:

"No one is born into this world with a religion engraved on their skin. To God, all paths are valid. Who was God before the birth of the founder of your religion?"

NWF emphasizes that these constitutional clauses violate the Universal Declaration of Human Rights (UDHR), adopted in 1948 and endorsed by Pakistan:
  • Article 1: All human beings are born free and equal in dignity and rights.
  • Article 18: Everyone has the right to freedom of thought, conscience, and religion.
  • Article 21: Everyone has the right to take part in government and access public service equally.
By requiring a specific religion for public office, these provisions:
  • Impose a religious test for leadership
  • Institutionalize discrimination against religious minorities
  • Undermine equal representation
This call for reform gains urgency in light of the April 22, 2025, attack near Pahalgam in Indian-administered Kashmir, where militants separated civilians by religion and executed Hindu and Christian men in front of their newlywed wives. This atrocity underscores how identity-based hate can be weaponized with devastating consequences.
