Aging Breath Testing Technology Faces Increased Legal Scrutiny
NEW YORK - EntSun -- More than 4,000 people were arrested for Driving While Intoxicated (DWI) in New York City during 2025. In many of those cases, prosecutors relied on breath alcohol evidence generated by the Intoxilyzer, a machine whose core technology has not changed since the 1970s.
Breath test evidence often becomes one of the most important pieces of evidence introduced in a DWI prosecution. A reported blood alcohol concentration above the legal limit can significantly strengthen the prosecution's case. However, the reliability of that evidence depends on whether the testing equipment has been properly inspected, calibrated, and maintained by an authorized service provider.
DWI defense attorneys across the country continue to investigate whether these machines receive routine maintenance that is required by law. Recent court decisions have shown that when maintenance records are incomplete or missing, the admissibility of breath test evidence can be challenged.

New York has established detailed requirements governing evidential breath testing instruments. Those requirements outline standards for inspection, maintenance, and calibration of approved breath testing devices.
These regulations require approved service providers to perform routine maintenance on Intoxilyzer instruments at least once each year. The inspections must verify that the equipment continues to operate within accepted performance standards.
Discovery Rules Give Defendants Access to Maintenance Records
New York's criminal discovery laws require prosecutors to provide significant evidence before trial. Under CPL § 245.20(1)(s), defendants may obtain records relating to the inspection, calibration, repair, certification, and maintenance of breath testing instruments used in their cases. These records allow defense attorneys to independently evaluate whether the equipment was functioning properly when the defendant submitted to testing.
Scientific Evidence Must Meet Legal Standards
Courts have long recognized that scientific evidence carries considerable influence with juries. A numerical blood alcohol reading may appear objective, but every scientific instrument requires proper maintenance to produce reliable measurements. Mechanical devices naturally experience wear over time. Sensors age. Components fail. Calibration may drift. Environmental conditions may also affect performance if equipment is not routinely inspected.

Florida Court Suppresses Breath Test Evidence
A recent Florida case illustrates why maintenance documentation has become increasingly important. In that case, a driver reportedly registered a blood alcohol concentration of .15 percent using an Intoxilyzer device.
During litigation, evidence emerged indicating that the breath testing instrument had not been maintained according to required procedures. The maintenance failure involved the replacement of all five o-rings. The court ultimately suppressed the breath test evidence.
