Is BPC-157 About to Be Legal? A Free Explainer on What the FDA's Peptide Policy Would Change

Peptide Price Lab's plain-language guide separates an advisory vote, a pending enforcement policy and the law itself, which buyers are hearing as one piece of news

AUSTIN, Texas - EntSun -- This month, people researching peptides have been told that BPC-157 and five other compounds are about to become legal, and few of the headlines explain what that would mean for them. Peptide Price Lab, a free site that compares prices and vets vendors for research peptides, has published a plain-language explainer on where the FDA's proposed interim peptide policy stands and what it would change for someone buying today.

The headlines draw on separate events. In July, the FDA's Pharmacy Compounding Advisory Committee voted to recommend six of the seven peptides it reviewed (BPC-157, KPV, TB-500, MOTS-c, Epitalon and Semax) for the list of substances pharmacies may compound, three of them by 8 to 6. On October 14, HHS and the FDA sent an "Interim Access Policy for Compounding Using Certain Peptides" to the White House Office of Management and Budget for review. The federal review record still lists it as pending, and its text hasn't been published.

The explainer pulls apart the vote, the policy and the law, which are easy to read as one story. The committee's vote is a recommendation the FDA doesn't have to follow. The law firm Holland & Knight expects the interim policy to work through enforcement discretion, which the firm describes as the FDA signaling that it won't act against licensed compounding pharmacies making certain peptides for individual patients. The firm notes that a policy like that wouldn't change the underlying law or make any compounded peptide FDA-approved.

If the policy works the way Holland & Knight expects, the new route would run through a prescription and a compounding pharmacy, and research peptides sold online would stay outside it.

Peptide Price Lab tracks prices for all six recommended compounds, each listed by between 39 and 44 of the 49 vetted vendors on the site. Every vendor is checked against the same rubric, at least 64 data points across 11 categories, and a vendor can't move its score by paying the site.

"The headlines about peptides becoming legal have run well ahead of the paperwork," said the Peptide Price Lab team. "We wrote this so people can see what's been voted on, what's been proposed and what's actually law, then make their own decisions. The policy text isn't public yet, and we'll update the guide the day it is."
