Supreme Court Upholds Birthright Citizenship, Blocking Trump Executive Order

TEMPLE TERRACE, Fla. - EntSun -- The U.S. Supreme Court ruled 6-3 today to uphold birthright citizenship under the 14th Amendment, striking down President Trump's executive order that sought to deny automatic citizenship to children born in the United States to parents who are unlawfully or temporarily present in the country. Barbara* was authored by Chief Justice John Roberts, who wrote that the Framers of the 14th Amendment "extended that promise to 'every free-born person in this land' — we keep that promise today."

The timing of the ruling is striking. It comes days after the court's June 25 decision allowing federal agents to turn back asylum seekers before they physically enter the United States — a ruling immigration advocates called a catastrophic blow to the right to seek refuge. Simultaneously, a new USCIS policy memo is requiring most immigrants on temporary visas to leave the country and pursue green cards through consular processing abroad, dramatically limiting in-country adjustment of status.

Yakzan notes that parents of U.S.-citizen children can still face deportation, and that the USCIS memo may cut off green card pathways that were previously available inside the country. "Today's ruling protects the child's status. It does not protect the family unit unless the parents also have lawful status or a viable path to it. That distinction matters enormously."
