Live Events Standards Council Files in Federal Court Over DOJ-Live Nation Settlement Gaps

Independent certification body argues consent decree leaves fans, artists and venues without enforceable consumer protections in post-settlement market
SAN JOSE, Calif. - EntSun -- The Live Events Standards Council (LESC), an independent, non-industry-funded standards body, has filed a formal public-interest submission in the USA v. Live Nation antitrust remedies proceeding in the Southern District of New York, arguing that the DOJ consent decree restructures market competition without mandating fairness within it.
The consent decree, finalized March 9, 2026, opens Ticketmaster's platform to competitors and caps exclusivity contracts at four years. Twenty-seven state attorneys general -- including those of New York, California, and Ohio -- refused to sign it, calling it insufficient. New York AG Letitia James stated the settlement "fails to address the monopoly at the center of this case, and would benefit Live Nation at the expense of consumers." The $280 million fine imposed on Live Nation represents approximately four days of the company's 2025 revenue.

The filing presents a framework for enforceable consumer standards the decree currently omits: all-in price transparency, verified bot protection, artist autonomy protections, non-exclusive ticketing rights, and fan-first resale policy -- the five standards that protect fans and artists once competition begins.
"The settlement opened the door to competition," said Victoria Cortez, Founder of the Live Events Standards Council. "It did not mandate how that competition treats fans, artists, or independent venues. The decree has no all-in pricing requirement. No bot protection standard. No artist autonomy clause. We filed to put that on the record."
The FTC's 2025 complaint against Live Nation documented $16.4 billion in hidden mandatory fees on $82.6 billion in ticket sales from 2019 to 2024, with markups reaching 44% above listed prices. The same complaint revealed Ticketmaster rejected anti-bot technology because scalpers were good for revenue. The Senate Permanent Subcommittee on Investigations "So Casually Cruel" report, released March 16, 2026, corroborated systematic venue retaliation, deliberate fee obfuscation, and bot ecosystem facilitation -- none of which the consent decree addresses.

LESC operates Front Row Certified, the first independently audited venue-level certification for the live events market. Certification requires venues and platforms to meet all five consumer-protection pillars the decree omitted. Certification is earned through independent audit, not purchased. The organization is funded entirely through public contributions and certification application fees. No funding is accepted from Live Nation, Ticketmaster, or any entity subject to certification review.
