Idaho: Gov. Little announces new appointments

Boise, ID – Governor Brad Little announced today his appointments of Theodore J. Fleming and Gene A. Petty to serve on the Idaho Court of Appeals, Cortney Liddiard to serve on the Idaho Transportation Board, and Erika Malmen to serve of the Idaho Park and Recreation Board.
Idaho Court of Appeals
Theodore J. Fleming
Fleming has served as a District Judge for Idaho's Fourth Judicial District since his appointment to the district bench in September 2022. He previously served as a magistrate judge in Elmore County from 2016 to 2022. Fleming has also presided over the Elmore County Drug and DUI Court and the Ada County Drug Court. Prior to his judicial service, he was a partner at Fleming Law Offices, PLLC in Emmett and was a deputy prosecuting attorney in the Canyon County Prosecutor's Office from 2006 to 2013. He holds two bachelor's degrees from the College of Idaho, a J.D. from Oklahoma City University School of Law, and a Master's in Public Administration from Boise State University.
"I am deeply humbled and honored by Governor Little's confidence in selecting me to serve on the Idaho Court of Appeals," Fleming said. "I have strived over the last 21 years of my legal career, all but three of which I have dedicated to public service, to serve the people of the State of Idaho and my community with honor, integrity, and a firm commitment to the rule of law."
Fleming will fill the vacancy on the Court of Appeals created by the retirement of the Honorable Judge David Gratton.

Gene A. Petty
Petty has served as a District Judge in Idaho's Third Judicial District since his appointment in 2017 and was re-elected in 2018 and 2022. He serves as presiding judge for the Canyon County Mental Health Court and as a member of the Idaho Behavioral Health Council, and he has also chaired both the Idaho Academy of Leadership for Lawyers and the Idaho State Bar's Professionalism and Ethics Section. Prior to the bench, he practiced civil litigation in the Ada County Prosecuting Attorney's Office for more than 13 years and served as an adjunct professor at Concordia University School of Law. Petty earned his bachelor's degree from California State University, San Marcos and his Juris Doctor from Loyola University Chicago School of Law.
"I am honored by this appointment and grateful for the opportunity to serve our state as Judge of the Idaho Court of Appeals. I appreciate Governor Little entrusting me with this important responsibility." Petty said. "Serving the people of southwest Idaho as a district judge in the Third Judicial District for the past nine years has been an immense privilege, and I am thankful for the support of my fellow judges and our dedicated court staff. As a member of the Idaho Court of Appeals, I will remain devoted to upholding the rule of law, ensuring justice, and discharging my duties with humility and integrity."
Petty will fill the vacancy on the Court of Appeals created by the retirement of the Honorable Judge Molly Huskey.

Idaho Code § 1-2101 et seq. governs the process for filling judicial vacancies in the Idaho Supreme Court, Idaho Court of Appeals, and District Courts. Under Idaho law, the Idaho Judicial Council submits a list of at least three qualified candidates to the Governor for appointment.
Idaho Transportation Board
Cortney Liddiard
Liddiard is the founder of Kerosene Capital, an investment firm focused on real estate investments. He served as chief executive officer of the commercial real estate and private equity company Ball Ventures until March of 2024. Liddiard serves on the Blue Cross of Idaho board. He earned bachelor's and master's degrees from Utah State University.
"I am grateful for Governor Little's decision to appoint me to the Idaho Transportation Board. I look forward to drawing on the experience I've gained throughout my career to give back to the state that has given so much to me and my family by helping expand opportunity across Idaho and make a meaningful difference," Liddiard said.
Idaho Park and Recreation Board
Erika Malmen
Malmen is an Idaho native and the Boise Office Managing Partner at the law firm of Perkins Coie LLP. She started her career in 2000 at the Idaho Governor's Office of Species Conservation, followed by a stint at the Department of the Interior Solicitor's Office in Washington, D.C. Her law practice is currently focused on advising clients in the mining, agribusiness, energy, and utility industries. Her state, federal and private practice experience make her uniquely qualified to serve on the Board.
"I am deeply honored that Governor Little has appointed me to serve. Outdoor recreation is vital to the quality of life and the economy in Idaho, and I look forward to working with other members of the Board to enhance outdoor experiences and opportunities for all Idahoans," Malmen said.
Idaho Court of Appeals
