Idaho continues to strengthen partnership with ICE to enforce nation's immigration laws

BOISE, Idaho ~ Idaho Governor Brad Little and Idaho Department of Correction (IDOC) Director Bree Derrick have announced that the state has entered into a 287(g) Warrant Service Officer agreement with U.S. Immigration and Customs Enforcement (ICE). This agreement further solidifies Idaho's commitment to working with the federal government in enforcing immigration laws.

The agreement, which was signed on August 28, formalizes a process that IDOC has already been using to assist ICE with individuals who are incarcerated in Idaho prisons and are subject to federal immigration enforcement actions. Under this agreement, designated IDOC officials are authorized to serve existing ICE administrative warrants on these individuals.

Governor Little stated that Idaho has a responsibility to uphold the rule of law and protect its citizens. He believes that this agreement will provide another tool for ensuring that criminal aliens who are subject to federal immigration enforcement are transferred to federal custody after completing their sentences in Idaho. The governor also expressed his commitment to working with the Trump administration in securing communities and supporting the enforcement of national laws.

This new agreement builds upon Idaho's existing cooperation with ICE through Operation No Return, an initiative launched by Governor Little to strengthen coordination between state law enforcement and federal immigration authorities. In 2025, Idaho became one of the first states to enter into a 287(g) agreement under Operation No Return, allowing designated personnel from the Idaho State Police (ISP) to assist ICE by transporting dangerous illegal alien criminals from Idaho communities after they have completed their sentences for crimes committed in both Idaho and the United States. This partnership has resulted in the removal of numerous criminal aliens from Idaho neighborhoods and improved coordination between state and federal authorities.

The 287(g) program enables ICE to enter into agreements with state and local law enforcement agencies for performing certain immigration enforcement functions under federal oversight. IDOC has a history of providing ICE with information on individuals incarcerated for felony convictions, which helps ICE identify those who may be subject to immigration detainers. The department also facilitates due process hearings for individuals undergoing deportation proceedings and coordinates with ICE when Idaho sentences are completed.
