Blockchain Evidence Gains Ground in Intellectual Property Cases as Courts Examine Digital Proof

Courts, lawmakers, and intellectual property organizations are increasingly examining blockchain timestamps, cryptographic hashes, and digital records as tools for establishing proof of creation and evidentiary integrity.
COLUMBUS, Ohio - EntSun -- Across disputes involving copyrights, trademarks, trade secrets, designs, and other digital assets, courts and intellectual property organizations are examining how blockchain records can help establish when a work existed, whether it has been altered, and how its digital history can be independently verified.
For creators and companies, blockchain is increasingly being examined as a way to establish proof of creation, proof of existence, chronology, and the integrity of digital intellectual property.
The World Intellectual Property Organization has identified blockchain as an emerging technology with potential applications throughout the intellectual property ecosystem. WIPO has established a Blockchain Task Force to examine blockchain applications involving IP offices, rights holders, applicants, and other stakeholders.

The legal system is evolving as well.
A 2024 peer-reviewed study titled Blockchain in the Courtroom: Exploring Its Evidentiary Significance and Procedural Implications in U.S. Judicial Processes, examined blockchain evidence within the American judicial system.
Researchers found that blockchain's characteristics strengthen the integrity and authentication of electronic evidence.
Federal evidence rules are adapting to digital records. Federal Rules of Evidence 902(13) and 902(14), adopted in 2017, provide mechanisms for authenticating electronically generated or copied information.
A cryptographic hash functions as a digital fingerprint of a file. When that fingerprint is associated with a trusted timestamp and recorded through blockchain technology, it can help establish that a particular digital asset existed in a particular form at a particular point in time. Altering the underlying file changes its digital fingerprint, providing another mechanism for evaluating integrity.
That capability is becoming increasingly relevant as AI dramatically accelerates the creation, duplication, modification, and distribution of digital content.

In an AI-driven economy, intellectual property disputes may increasingly turn not only on what was created, but on who can produce credible evidence showing what existed, when it existed, and whether it has remained unchanged.
